Intellectual Property Policy — Hala Platform

Welcome to Hala real estate booking platform. This policy defines the intellectual property rights related to the platform, its content, and its services. It outlines the obligations of users, investors, and property owners regarding the protection of these rights. By using the Hala platform, you agree to comply with all provisions of this policy.

• Platform: The Hala website and application and all related services.
• Content: Texts, images, videos, designs, icons, logos, data, and any other digital materials.
• User: Any person who browses the platform or makes a booking through it.
• Investor: The owner of a property or residential unit listed on the platform.
• Services: All services provided through the platform including booking, payment, reviews, and service requests.

3.1 Trademarks
The name "Hala", the platform logo, and all associated trademarks are the exclusive property of Hala Company.
• It is prohibited to use, copy, imitate, or modify the trademark or logo in any form without prior written permission.
• The name "Hala" or any of its trademarks may not be used in a way that implies an unauthorized partnership or sponsorship.

3.2 Design & Interfaces
• All user interface designs (UI/UX), including layouts, colors, icons, and interactive elements, are protected intellectual property.
• It is prohibited to copy or simulate the platform design in whole or in part.

4.1 Platform Content
All content created or published by the Hala platform is protected under intellectual property rights, including but not limited to:
• Descriptions and texts: Building and unit descriptions, facilities and services (in Arabic and English).
• Official images: Property and unit photos taken or prepared by the platform.
• Marketing content: Promotional materials, articles, and social media posts.
• Aggregated data: Statistics, analytics, reports, and performance indicators.

4.2 User Content
• When a user publishes a review, they grant Hala platform a non-exclusive, perpetual license to use that content within the platform's services.
• Images uploaded by users remain owned by their original owners, with the platform granted necessary usage rights.
• The user bears full responsibility for ensuring their content does not infringe third-party intellectual property rights.

4.3 Investor & Property Owner Content
• Property descriptions, images, and information provided by investors remain their intellectual property.
• The investor grants the platform a non-exclusive license to use this content for displaying and marketing units.
• The investor warrants that all submitted content is original and does not infringe any third-party rights.

5.1 Source Code & Software
• All software systems, algorithms, databases, and APIs of the Hala platform are exclusive and protected intellectual property.
• Any attempt at reverse engineering, decryption, or disassembly of any part of the platform software is strictly prohibited.

5.2 Search & Recommendation Algorithms
• Smart search systems, unit result ranking, and recommendation algorithms are protected intellectual property.

5.3 Electronic Payment System
• Payment processing systems and integrated payment gateways are protected and any attempt to manipulate or exploit them is prohibited.

6.1 Booking Data
• All booking data — including check-in/check-out dates, financial amounts, and guest data — is confidential and protected.
• Investors and users are prohibited from sharing this data with external parties without prior permission.

6.2 Personal User Data
• Users' personal information is protected under the privacy policy and Saudi Arabia's personal data protection regulations.
• User data available through the platform may not be used for marketing or commercial purposes outside Hala's services.

6.3 Financial Data
• All financial data — including payment details, revenues, and investor ratios — is confidential and subject to the highest protection standards.
• Disclosure of any financial information to unauthorized parties is prohibited.

Users, investors, and visitors are prohibited from:
• Copying and Distribution: Copying, republishing, or distributing any platform content without prior written permission.
• Web Scraping: Using automated programs or tools to extract data or content from the platform.
• Creating Derivative Works: Creating products or services based on the platform's content or design.
• Unauthorized Commercial Use: Using any platform content for commercial purposes without a licensing agreement.
• Tampering with Watermarks: Removing or modifying any copyright notices or watermarks added to content.
• Infringing Third-Party Rights: Uploading or publishing content that infringes third-party intellectual property rights.

8.1 How to Report
If you believe any content on the Hala platform infringes your intellectual property rights, please provide:
• Description of the infringed content: Identify the original content you own that you believe has been infringed.
• Location of the infringing content: A link or precise description of the infringing content's location on the platform.
• Proof of ownership: Documents or evidence proving your ownership of the original content.
• Contact information: Your full name, email, and phone number.
• Good faith declaration that the report is made in good faith and the information provided is accurate.

8.2 Platform Procedures
• The report will be reviewed within 5 business days.
• The infringing content may be temporarily removed during the review period.
• Both the reporting and reported parties will be notified of the review outcome.
• If infringement is confirmed, content will be permanently removed and additional action may be taken against the violating account.

9.1 Platform Actions
If an infringement is confirmed, Hala platform reserves the right to take any of the following actions:
• Immediate removal of the infringing content.
• Suspension or cancellation of the violating account.
• Cancellation of any active bookings associated with the violating account.
• Blocking access to profits or financial dues pending resolution of the violation.

9.2 Legal Proceedings
• Hala platform reserves the right to take appropriate legal action against any intellectual property infringement, including claims for material and moral damages.
• Disputes related to intellectual property are subject to Saudi Arabian regulations and competent judicial authorities.

10.1 Payment Services
• Trademarks of payment service providers integrated into the platform are intellectual property of their respective owners and are used only to indicate available payment methods.

10.2 Communication Services
• Names and logos of communication services used (WhatsApp, email, etc.) are intellectual property of their respective companies.

10.3 Licensed Content
• Any content licensed from third parties (images, fonts, icons) is used in accordance with its specific licensing terms, and intellectual property rights remain with their owners.

• Hala platform reserves the right to amend or update this policy at any time.
• Users will be notified of any material changes via email or platform notifications.
• Continued use of the platform after amendments constitutes acceptance of the updated policy.

This policy is governed by the laws and regulations of Saudi Arabia, including:
• The Copyright Protection Law issued by Royal Decree No. M/41.
• The Trademark Law issued by Royal Decree No. M/21.
• The Patent and Industrial Design Law and related regulations.
• The Personal Data Protection Law (PDPL).
